1. Definitions
- "App" means the IntenSync mobile application hosted under Equilibelle App Solutions.
- "User" means any individual who downloads, registers for, or uses the App.
- "Service" means the functionality and features provided by the App.
2. Acceptance of Terms
By downloading, accessing, or using the App, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you disagree with any part of these terms, you may not use the App.
3. Eligibility
You must be at least 13 years old to use the App. If you are under 18, you must have parental or guardian consent to use the Service.
4. Account Registration
- Users must register via Firebase Authentication using a valid email address.
- You are responsible for keeping your account credentials secure.
- Notify us immediately of any unauthorized access or security breach.
5. Subscriptions & Payments
Certain premium features require a paid subscription through the Apple App Store or Google Play Store:
- All payments and billing inquiries are handled by the respective App Store. Equilibelle App Solutions does not directly process payment data.
- Subscription fees, renewals, and refunds are subject to the App Store’s policies.
- You may cancel or modify your subscription through your App Store account settings.
5.1 Consumer Protection & Cancellations
You have certain rights under the Prince Edward Island Consumer Protection Act and other Canadian laws that cannot be waived by contract. Nothing in these Terms limits those rights.
- Automatic Renewals: Subscriptions auto-renew through your Apple or Google Play account. You can turn off auto-renewal at any time in your account settings.
- Refunds: For billing issues or refund requests, please contact Apple or Google Play support first. You may also reach out to us at support_intensync@equilibelle.com for assistance.
- Business Address: Equilibelle App Solutions (Sole Proprietorship), Charlottetown, PE, C1A 0K1, Canada
International Users: If you are a consumer resident outside Canada, you also benefit from any mandatory rights and remedies provided by the consumer-protection laws of your home country. Nothing in these Terms affects those non-waivable rights.
6. License Grant & Restrictions
- Equilibelle App Solutions grants you a limited, non-exclusive, non-transferable license to use the App on your personal device.
- You may not:
- Reverse engineer, decompile, or disassemble the App.
- Use the App for any unlawful or unauthorized purpose.
- Distribute or rent the App to third parties.
7. User Conduct
Users agree not to:
- Interfere with the security or functionality of the App.
- Upload or transmit any malicious code or content.
- Harass, threaten, or violate the rights of other users.
8. Intellectual Property
All content, trademarks, logos, and code in the App are the property of Equilibelle App Solutions or its licensors. You may not use them without express written permission.
9. Disclaimers & Limitation of Liability
The App is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, Equilibelle App Solutions is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the App.
10. Indemnification
You agree to indemnify and hold Equilibelle App Solutions, its officers, employees, and agents harmless from any claims, liabilities, damages, losses, or expenses arising from your use of the App or violation of these Terms.
11. Governing Law & Dispute Resolution
These terms are governed by the laws of Prince Edward Island, Canada. Any dispute may be brought in the courts of Charlottetown, PEI, or in the courts that have mandatory jurisdiction under applicable consumer-protection law.
12. Changes to Terms
We may update these Terms at any time by posting revised terms with an updated “Last updated” date. Continued use of the App constitutes acceptance of the new terms.
